TERMS AND CONDITIONS

1. Prices
All prices are correct at time of display online and include UK duty and VAT (VAT no. 243 4072 87). In the unlikely event of an administrative error resulting in an administrative error resulting in an incorrect price being displayed, we reserve the right to correct the price. In the circumstances you will be contacted and advised of the correct pricing, and you will be asked to contact us to confirm whether or not you wish to proceed with the order. Until confirmation is received, your order will remain in a pending state, and you will not be charged.

All standard delivery charges are automatically worked out according to the delivery postcode entered at the check-out stage. Surcharges are however, applicable to 'Highlands and Islands' addresses (see delivery section for tariff table), which will not appear at the time of ordering. Should a surcharge be applicable to any order placed, you will be contacted by email and advised of the charges, and you will be asked to contact us to confirm whether or not you wish to proceed with the order. Until confirmation is received, your order will remain in a pending state, and you will not be charged.

2. Payment
We accept the following cards as means of payment: Visa, MasterCard, Maestro, Delta, American Express and JCB. If you are unsure about whether your card will be accepted, or would like to arrange an alternative means of payment, please do not hesitate to contact us on 020 7353 5384.

All credit and debit card payments are subject to validation chrcks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment to us, we will not be liable for any delay or non-delivery of goods. If you believe your credit or debit card has been subject to unauthorised or fraudulent use you should contact your credit card issuer without delay.

We will not sell or deliver alcohol to anyone who is, or appears to be, under the age of 18. By placing an order you confirm that you are at least 18 years old and we reserve the right not to deliver if we are unsure of this.

3. Delivery of Goods
El Vino aims to deliver all orders within five working days from date of receipt of order (unless a later delivery date has been specified). Working days do not include weekends and UK bank holidays. Over the Christmas period, gift orders placed very early may be held for delivery during the fortnight before christmas unless immediate delivery is specified.

Deliveries to non-mainland or remote locations may take longer than five days. If we are unable to deliver your order, or if there will be a significant delay in delivering your order, we will contact you within five working days. We do not accept responsibility for delays to orders with incomplete or incorrect delivery addresses/instructions. Please ensure that you provide us with full delivery details to avoid delays of this nature.

Please note that our couriers run a signature only service, and are unable to leave goods in unattended locations (such as a garden shed or porch). Should you wish your wines to be left in such a location, we must receive written confirmation from you (e-mails are acceptable for this purpose) stating that you are prepared to accept responsibility for the wine to be left without a signature. All risk for the goods will pass to you in this instance.

Deliveries are made during office hours on week-days. We cannot guarantee the time of day for standard deliveries. Should you require delivery at a specific time or during the weekend, please contact our head office and we will provide you with a quote.

Delivery surcharges apply to off-shore and Scottish Highland addresses. Please find a full delivery charge tariff table below:

For all orders to postcodes stipulated in the surcharge table above, both the standard delivery chrage and surcharge will be applicable. The only exception to this is in the instance of a case or gift advertised with free delivery, in which case only the surcharge will be applicable.

If a surcharge is applicable to your order you will be contacted by e-mail and advised of the charges, and you will be asked to contact us to confirm whether or not you wish to proceed with the order. Until confirmation is received your order will remain in a pending state, and your card will not be charged.

We do not deliver outside the UK.

4. Vintages and Availability
El Vino will always try to ensure that the wines are of the vintage quoted on the site. In the event of a bottle no longer being available we will, unless otherwise instructed, substitute it with the next vintage. Should this not be available, you will be contacted with our recommendation of the wine most similar in style, quality and price, and your order will remain pending until we receive either confirmation or cancellation of the order from you. Please note that no payment will be taken from your card until the order is confirmed.

Should you order from our gift case selection, we reserve the right to substitute any single item that may be out of stock for an item of equal or higher value so that no delay is caused in dsepatch of the gift.

5. Returns, Guarantees & Cancellation
Our philosophy at El Vino is to provide our customers with quality wines and value for money. Wine is, however, a complex product and due to its nature, faults do occasionally occur. Should you not be entirely satisfied with our products, and providing it is within a reasonable time period, please return them to us and we will be happy to offer a refund or replacement.

All goods must be examined at the time of delivery and it is your responsibility to notify El Vino of any breakages or delivery error within three days. Any failure to comply may result in the non-satisfaction of any claim.

You have the right to cancel your order for any reason within 7 working days from the day you receive the goods. You will, however, have to pay the cost of returning the goods to us. We will refund the balance of your payment within 30 days of the cancellation.

6. Privacy Policy
We collect information about you in order to:

- Provide our couriers with delivery name, address & contact details

El Vino will not pass on any personal details to other third parties.
